Difficulties with an Attorney

Filing a Complaint against an Attorney
If you think that your attorney has acted unethically, you may file a complaint against him or her with the Bar Counsel's Office of the Idaho State Bar.   Bar Counsel's office will review your complaint to determine whether or not the attorney has violated the Idaho Rules of Professional Conduct and whether or not discipline should be imposed.  If you are interested in finding out more information about the how to file a complaint, Click Here.

Fee Disputes with Attorneys

Fee matters are not generally a basis for discipline because they usually do not involve questions of ethics or professional misconduct.  There is no such thing as a "standard fee" for a particular type of case.

If requested by their client, an attorney is required to provide an accounting of fees charged.  If you are having a dispute with your attorney concerning fees, you should request such an accounting.   If, after you receive the accounting, you feel that your attorney's fees are still too high, you may wish to enter into Fee Arbitration.

The Fee Arbitration Forms  PDF Document - Click Here for Acrobat Reader are available in PDF format.  If you are unable to open and print the PDF version of the forms, contact the Bar Counsel's Office to request a copy by mail.

Section VII of the Idaho Bar Commission Rules governs Fee Arbitration.

What if I feel that my attorney misappropriated my funds?

Under special provisions of the Idaho State Bar and Supreme Court Rules, a fund has been created to compensate clients for all or part of any losses caused by the "dishonest" conduct of a lawyer admitted to practice in Idaho. Under the program, fees are paid by all lawyers throughout the state to assist in compensating members of the public for an Idaho lawyer's dishonest conduct when the claimant has no other recourse to recoup the loss. "Malpractice" is not necessarily dishonest conduct, and the distribution of funds is limited to victims of "dishonest" actions. If you feel that you may qualify, contact the Idaho State Bar for further information about the Client Assistance Fund.
